Welcome to Loop Tours. By booking a tour with us or using our website https://thelooptours.com , you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Definitions

• “Company,” “we,” “our,” “us” refers to Loop Tours.
• “Customer,” “you,” “your” refers to the person who books a tour or uses our services.
• “Tour” refers to the travel services provided by Loop Tours, including but not limited to tours throughout Vietnam.

2. Booking & Payment

• Booking: All bookings are subject to availability and are not confirmed until you receive a confirmation email from us.
• Payment:
• For bookings with start date within 07 days after the booking date: a full payment of 100% total tour cost is required at the time of booking.
• For bookings with start date later than 07 days after the booking date: A deposit of 25% of the total tour cost is required at the time of booking. The remaining balance is due latest before the tour starts. Payments can be made via our online payment gateway or directly.

3. Changes and Cancellation Policy

3.1. Cancellation by customer

• 0% of the tour cost will be charged if cancelled more than 07 days before the trip.
• 50% of the tour cost will be charged if cancelled between 07 and 03 days before the trip.
• 75% of the tour cost will be charged if cancelled between 03 and 01 days before the trip.
• 100% of the tour cost will be charged if cancelled within 01 day/ 24 hours before the trip.

Cancellation notices must be given in writing and will be considered in accordance with Vietnamese time (UTC +7) in relation to the original booking date of your tour.

3.2. Cancellation by Loop Tour

Loop Tours reserves the right to cancel or postpone any tour at any time if it is necessary for the safety of our guests, guides, or equipment, or due to unforeseen operational issues. In the event Loop Tours cancels a tour, you will receive a full refund of all amounts paid, including the deposit. Bookings for third-party tours not listed directly on our website will be charged in accordance with our partners' cancellation policy. For payments made by card, we are unable to refund the card transaction fee.

3.3. Amendments to Itinerary

• Amendments by Company: For your safety, we reserve the right to make changes to the tour itinerary if necessary. Any changes will be communicated to you as soon as possible.
• Amendments by Customer: Requests for changes to your booking must be made in writing and are subject to availability. We will do our best to accommodate your request, but additional charges may apply. Any amendments to the confirmed booking made less than 24 hours before the tour starts will incur a fee equal to 25% of your original booking price to make up for the pre-arrangement services.

5. Travel Insurance

Travel insurance is mandatory for all customers and should cover personal injury, medical expenses, and repatriation costs. Each participant is solely responsible for all costs associated with medical care and evacuation.

5. Health and Fitness

• Fitness Level: Some tours may require a certain level of fitness. You are responsible for assessing your fitness level and ensuring you meet the tour requirements. Any activity you fail to attend during the tour is non-refundable.
• Medical Conditions: You must inform us of any medical conditions that may affect your participation in the tour. We reserve the right to decline your booking if we believe the tour is unsuitable for you.

6. Conduct and Behavior

• Code of Conduct: You agree to comply with local laws and regulations and to behave respectfully towards other customers, our staff, and local communities.
• Removal from Tour: We reserve the right to remove any customer from the tour if their behavior is deemed disruptive or harmful to the tour group.

7. Limitation of Liability

7.1. Force Majeure

• Force Majeure refers to unforeseeable circumstances outside of our control including, but not limited to: flood, fire, landslides, typhoons, freezing roads, ice storms, severe lightning, earthquakes, acts of government, civil unrest, or any other extreme weather or natural disaster.
• We are not liable for any failure or delay in performing our obligations due to events beyond our control, including natural disasters, political unrest, or other unforeseen circumstances.

7.2. Liability

• Our liability is limited to the amount you paid for the tour. We are not liable for any indirect, incidental, or consequential damages.
• Safety gear is provided for every guest at the beginning of their tour, including a helmet with a 3/4 visor, knee pads and elbow pads. Please note that if you choose not to wear this gear for the entirety of the tour, Loop Tours is not liable to refund for any injury occurring during the tour, regardless of whether the protective equipment would have prevented the injury or not.
• Self-driving riders must comply with the licensing regulations of Vietnam. Please note that if you choose to self-ride, you are responsible for ensuring your license is valid. We reserve the right to refuse any driver without proper documents. You are responsible for the rented motorbike for the duration of the tour and agree to pay for all damages that occur to the motorbike from the time it leaves our property to the time it is returned. As a self-driver, you accept liability for all damages to your rented motorbike, as well as any damage to 3rd parties in the event of an incident.

8. Complaints

• If you have a complaint during the tour, please notify your tour guide or contact us immediately so we can address the issue. If the complaint is not resolved to your satisfaction, you must submit a written complaint within 1 day after the tour end date. No refunds will be issued for complaints received more than 1 day post-tour.
• For any issues with our 3rd-party providers (e.g., homestays or buses), please notify us as soon as they occur so we can resolve them with the provider. Please note that if the issue is not brought forward at the time of occurrence, a request for refund may not be honored.

11. Prices & Taxes
We reserve the right to adjust prices in the event of changes in exchange rates or price increases made by suppliers due to special requests from Our Guests. If the cost of any service increases due to exchange rate fluctuations, price increases, tax changes or any other reason, you are required to pay the increase upon notice or as it is implemented on our website or you may cancel the booking which may result in cancellation fees. We are not liable in any way if any increase occurs. Rates quoted are appropriate to the particular product at the time of quoting and these rates may change before the travel date. All prices are subject to availability and can be withdrawn or varied without notice.
